Industry Rules and Regulations
Contrary to the efforts in Washington D.C. to relax regulations that are choking small business owners, I am not sure the message is getting to our industry and market here in New York.
Be advised that the New York City Local Law 204 goes into effect next month. The highlights of chapter 33 of the New York City building code new section 3301.12 are as follows. Each permit holder at a site that is bound to Local Law 204 will require pre shift safety meetings by a competent person such as a site safety manager, site safety coordinator or a construction superintendent certified to conduct the meeting. Pre shift meeting will review activities and tasks along with specific safety concerns and risks associated with fulfilling such work.
Record meeting minutes shall include:
Date and time of each meeting
Name, title and company affiliation of each worker
Name, title and company affiliation of the competent person who conducted the meeting with an accompanying signature
Understanding and conforming to regulations imposed by institutions such as Dormitory Authority of the State of New York (DASNY), Department of Design and Construction (DDC), New York City Economic Development Corporation's (NYCEDC), School Construction Authority (SCA), Department of Citywide Administrative Services (DCAS), NYC Department of Environmental Protection (EDC), Vendor Information Exchange System (VENDEX) and Procurement and Sourcing Solutions Portal (PASSPort), can be numbing at times.
Should you choose to do work for these institutions, I urge you to do your due diligence in understanding the mind boggling rules and regulations you will be bound to and you have alignment with the respective Collective Bargaining Agreements you are signatory with. Beware the light you may see at the end of the tunnel just might be a train heading your way.
